Agreeing to these terms
These terms cover your use of the Heartland Berkeley Concrete Company website and any estimate or work you ask us for. By using the site, asking for an estimate or booking a job, you agree to them. If you don't agree, please don't use the site or book work with us.
Any signed written agreement or estimate for a specific job is part of these terms. If the two ever disagree, the written agreement for that job is the one that applies.
What we do
Heartland Berkeley Concrete Company is a concrete contractor in Berkeley, CA. We build driveways, patios, sidewalks, steps, foundations and other concrete work for homes and properties in Berkeley and the cities around it. You can see our services from the home page and read more about us.
The information on this site explains the trade in general terms. It isn't a quote, a promise that a service fits your property, or engineering or legal advice. The scope of your job is set by its written estimate.
Estimates and pricing
Our estimates are free and come with no obligation. We base each one on what we see at your property, such as the size of the area, the condition of the ground the slab will sit on, access for the crew and trucks, drainage, removal of old concrete and the finish you choose.
Some things only show up once the old slab is out or the ground is open, like soft soil, roots, old footings or buried lines. If we find something that changes the work, we'll stop, explain it and give you the added cost in writing before we go ahead, and we won't charge for extra work you haven't approved.
An estimate is good for the time stated on it. After that, material and labor costs may have changed, so we may need to update it.
Scheduling, weather and cancellation
We set a start date once you approve the estimate. Rain, extreme heat or ground that's too wet can push a pour back, because concrete poured in the wrong conditions makes a weaker slab, so we'll tell you as soon as we know and set a new date.
If you need to cancel or reschedule, call us at (341) 209-8254 as early as you can. If you cancel after we've ordered materials, booked a concrete delivery or started work, you'll owe for those costs and for work already done, as your written agreement sets out. This doesn't limit any right to cancel you have under California law.
New concrete needs time to cure, which is the wait while it hardens and gains strength. We'll tell you when it's ready to walk on and drive on, and damage from using it sooner isn't covered.
Your part of the job
You agree to give our crew safe access to the work area, keep pets and vehicles clear while we work, and tell us about anything we should know, such as sprinkler lines, buried utilities or where your property line runs.
If your job needs a permit, the written agreement will say who gets it.
Payment
Your written agreement sets out any deposit and when payments are due, and any deposit will follow California law. Unless the agreement says otherwise, the balance is due when the work is finished.
If a payment is late, we may pause work until it's paid and charge any late fee the written agreement allows. Where the law allows it, you're responsible for reasonable costs we have to pay to collect an overdue balance.
Our guarantee and its limits
Satisfaction is guaranteed on every job. If something about the finished work isn't right, call us, and we'll come look at it and make it right where the problem comes from our work.
Concrete can crack, even when it's built right. We cut control joints, grooves that give the slab a planned place to crack, so most cracks land there, but fine hairline cracks, slight color differences between pours and surface wear from weather are normal and aren't defects.
We aren't responsible for damage from things outside our control, such as ground movement, tree roots, earthquakes, flooding, chemicals spilled on the surface, vehicles heavier than the slab was built for, drainage changes made after we finish, or other people's work on or near the slab.
Apart from what's written here and in your agreement, we make no other warranties, express or implied, to the extent the law allows.
Limits on our liability
To the extent California law allows, our total liability for any claim connected with a job is limited to the amount you paid us for that job. We aren't liable for indirect or consequential losses, such as lost use of your property or lost income.
Nothing in these terms limits liability that the law doesn't allow to be limited.
The website is provided as is. We try to keep it accurate, but we don't promise it's complete, current or free of errors, and we aren't responsible for other sites it links to.
Settling a disagreement
If you have a problem with our work, call us first, because most issues get sorted out with a conversation at the job.
If we can't settle it that way, we both agree to try mediation in good faith before going to court. If that doesn't resolve it, either side can take the matter to the courts in Alameda County, California, including small claims court when the amount qualifies.
Which law applies
These terms, your use of this site and any work we do for you are governed by the laws of the State of California.
Changes to these terms
We may update these terms from time to time by posting the new version on this page. The version in place when you sign a written agreement is the one that applies to that job.
